Privacy Policy

1. Introduction

This Privacy Policy explains how Rascal PDX LLC, trading as Rascals Creative ("Rascals," "we," "us," or "our"), collects, uses, shares, and protects information when you visit rascalspdx.com (the "Site") or otherwise interact with us — for example, by submitting our contact form, signing up for our newsletter, or emailing us directly.

By using the Site, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use the Site.

2. Information We Collect

2.1 Information you give us directly

We collect information you choose to share with us, including:

  • Contact form: your name, email address, and any details you share about your brand, project, or "challenge." Our contact form is built and hosted using HubSpot, so this information is collected and stored in our HubSpot account.
  • Newsletter sign-up: your email address, and any other details you choose to provide when subscribing.
  • Direct email: any information you include when you email us at chat@rascalspdx.com.

2.2 Information collected automatically

When you visit the Site, we and our service providers may automatically collect:

  • Your IP address and approximate location
  • Browser type, device type, and operating system
  • Pages viewed, time spent on the Site, and referring or exit pages
  • Information collected through cookies and similar technologies, including those used by Google Analytics and HubSpot (see Section 4)

3. How We Use Your Information

We use the information we collect to:

  • Respond to enquiries submitted through our contact form or by email
  • Send our newsletter and other communications you've opted into
  • Manage our relationship with you, including follow-up communications and, in future, broader email marketing and customer-relationship management through HubSpot
  • Operate, maintain, secure, and improve the Site
  • Understand how visitors use the Site (analytics)
  • Comply with legal obligations and protect our legal rights

We do not sell your personal information.

4. Cookies and Similar Technologies

The Site currently uses cookies and similar tracking technologies from the following providers:

  • Google Analytics (Google LLC): we use Google Analytics to understand how visitors find and use the Site — for example, which pages are viewed, how long visitors stay, and what device or browser they're using. Google Analytics sets cookies (such as _ga and _gid) and processes this information in accordance with Google's privacy policy. Where enabled, Google Signals and ads personalization features may associate this activity with signed-in Google users for cross-device reporting.
  • HubSpot: our contact form is built and hosted using HubSpot. When you submit the form, HubSpot may set cookies on your device (such as hubspotutk) to recognize you on future visits and link your submission to your activity on the Site. HubSpot processes this information in accordance with HubSpot's privacy policy.

Cookies used on the Site fall broadly into these categories:

  • Essential cookies, needed for the Site to function correctly
  • Analytics cookies (Google Analytics), which help us understand how visitors use the Site
  • Forms/CRM cookies (HubSpot), which help us recognize returning visitors and manage contact form submissions

Cookie consent. When you first visit the Site, we display a cookie banner that lets you decline analytics cookies (Google Analytics). Essential cookies, and the forms/CRM cookies (HubSpot) used to run our contact and newsletter forms, remain active regardless of your choice, since the Site cannot function properly without them. You can change your choice at any time through the banner or your browser settings.

If your browser sends a recognized opt-out signal (such as Global Privacy Control), we will honor that signal as a request to opt out of the sale or sharing of your personal information and targeted advertising, to the extent those practices apply to Rascals.

We may share information with:

  • Service providers who help us run the Site and our business — currently including our website hosting provider, our email/newsletter platform (Substack), Google Analytics (Google LLC) for site analytics, and HubSpot for managing contact form submissions and, in future, broader email marketing and CRM.
  • Professional advisors, such as our accountant or lawyer, where necessary.
  • Authorities or other parties, where required by law, to protect our rights, or in connection with a business transfer such as a merger or acquisition.

We do not sell or rent your personal information to third parties for their own marketing purposes.

6. Data Retention

We keep information for as long as reasonably necessary for the purposes described in this policy — including to respond to your enquiry, maintain our newsletter list, and meet our legal and accounting obligations. You can ask us to delete your information at any time (see Section 8).

7. Your Privacy Choices and Rights

Newsletter: you can unsubscribe at any time using the link in any newsletter email, or by contacting us directly.

Access, correction, and deletion: depending on where you live, you may have rights to request access to, correction of, or deletion of your personal information, and to opt out of certain types of processing. To make a request, email us at chat@rascalspdx.com. We'll respond within the time required by applicable law.

8. Children's Privacy

The Site is not directed to children, and we do not knowingly collect personal information from anyone under the age of 13 (or 16, where a higher age applies under local law). If you believe a child has provided us with personal information, please contact us so we can delete it.

9. Data Security

We use reasonable administrative, technical, and organizational measures to protect the information we hold. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

10. International Visitors

The Site is operated from the United States. If you access the Site from outside the U.S., your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.

Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of rascalspdx.com (the "Site"), operated by Rascal PDX LLC, trading as Rascals Creative ("Rascals," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. About the Site

The Site provides information about Rascals' creative agency services, including our "Rascals Jam" sprint offering, and allows visitors to contact us and sign up for our newsletter. Nothing on the Site constitutes an offer or contract for services. Any engagement with Rascals is governed by a separate written agreement between Rascals and the client.

3. Intellectual Property

All content on the Site — including text, graphics, logos, the Rascals name and branding, "Rowdy Ideas," "Rascals Jam," and other materials (collectively, the "Content") — is owned by or licensed to Rascals and is protected by copyright and other applicable laws.

You may view and download Content for your own personal, non-commercial use. You may not reproduce, distribute, modify, republish, or create derivative works from any Content without our prior written consent, except as permitted by law.

4. Press and Third-Party Mentions

The Site displays logos and names of media outlets that have featured Rascals or its team's work (for example, in the "Featured In" section). These references reflect factual past coverage and do not imply any ongoing endorsement of, sponsorship by, or affiliation with Rascals by those organizations.

5. Information You Submit to Us

When you submit information through our contact form, our newsletter sign-up, or by emailing us, you confirm that the information is accurate and that you have the right to share it with us. THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RASCALS AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED THE TOTAL AMOUNT, IF ANY, THAT YOU HAVE PAID TO RASCALS IN CONNECTION WITH THE SITE.

11. Indemnification

You agree to indemnify and hold harmless Rascals and its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles. Any disputes arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Multnomah County, Oregon.
